Unauthorized Entities
Overview
In Florida, an unlicensed or unauthorized insurance entity refers to any person or business that engages in the business of insurance without first obtaining the necessary licensure or authorization from the Florida Office of Insurance Regulation (OIR). This includes selling, soliciting, negotiating, or advertising insurance products or insurance-related coverages—including motor vehicle service agreements, home warranty association, service warranty associations, and premium finance companies —without first obtaining a certificate of authority or the required license by the state.
OIR serves as the regulatory authority responsible for ensuring that insurers and related entities comply with state laws designed to protect consumers. When an entity operates without authorization, it not only violates state law but also puts consumers at significant financial risk, as unlicensed entities may not have the financial stability, reserves, or regulatory oversight necessary to guarantee claims payment.
To safeguard the public, OIR actively investigates reports of unlicensed activity. Allegations may arise when a consumer files a complaint, when unusual market activity is observed, or when insurers or agents bring potential violations to the agency’s attention. If an entity is found to be conducting unauthorized insurance transactions, the OIR has the authority to issue cease-and-desist orders, levy administrative fines, and refer cases for criminal prosecution.
OIR strongly encourages consumers to exercise due diligence when purchasing insurance or insurance-related products. Buyers should verify that the entity or individual offering coverage is properly licensed in Florida. This can be done by searching OIR’s active company database. Doing so helps ensure that the coverage being purchased is backed by a legitimate, regulated insurer and that policyholders will have recourse under Florida law if issues arise.

It is important to note that in order for OIR to pursue potential activity by an unlicensed entity, a transaction of insurance must have occurred. This means that the coverage or plan was purchased in Florida, and an exchange of money took place.
